Can Payday Loans Be Included in Chapter 7 Bankruptcy?
By the TCA Financial Editorial Team. Last reviewed: October 27, 2026.
Short answer: Yes. Payday loans are generally unsecured consumer debts, and they can be included in a Chapter 7 bankruptcy and discharged like credit card or medical debt. Filing triggers an automatic stay that stops most collection (U.S. Courts). Two catches: a lender can ask the court to keep a loan you took out by fraud from being discharged (11 U.S.C. 523(a)(2)), and the stay does not block the presentment of a check you already gave the lender (11 U.S.C. 362(b)(11)).
Key points
- Chapter 7 sells nonexempt property to pay creditors, and an individual case usually ends with a discharge of debts (U.S. Courts).
- Most collection actions, including lawsuits, wage garnishments and collection calls, stop when you file (U.S. Courts; 11 U.S.C. 362).
- A lender can object to discharging a specific debt it says was obtained by false pretenses or fraud (11 U.S.C. 523(a)(2)).
- You must take a credit counseling briefing from an approved agency within 180 days before you file (11 U.S.C. 109(h); U.S. Trustee Program).
- A bankruptcy can stay on your credit report for up to 10 years (15 U.S.C. 1681c).
How payday loans are treated in Chapter 7
A payday loan is usually an unsecured debt: the lender holds a post-dated check or a debit authorization, not a lien on your property. In Chapter 7 the case trustee gathers and sells nonexempt assets and pays creditors; if all your assets are exempt, the trustee files a “no asset” report and unsecured creditors get nothing (U.S. Courts). At the end of the case, the court issues a discharge, generally 60 to 90 days after the date first set for the meeting of creditors (U.S. Courts). Debts covered by the discharge can no longer be collected from you (11 U.S.C. 524).
| Question | What the law says |
|---|---|
| Can the payday loan be listed in Chapter 7? | Yes. List every creditor, including payday lenders and collectors (U.S. Courts) |
| Do collection calls and lawsuits stop? | Yes, most do once you file, under the automatic stay (11 U.S.C. 362(a)) |
| Can the lender still cash my post-dated check? | The stay does not cover presentment of a negotiable instrument (11 U.S.C. 362(b)(11)); talk to your bank about a stop payment |
| Can the lender stop the discharge? | Only for that debt, and only by proving grounds such as false pretenses or fraud (11 U.S.C. 523(a)(2)) |
| What must I do before filing? | Credit counseling with an approved agency within 180 days before filing (11 U.S.C. 109(h)) |
| What does filing cost? | Court fees total $338: a $245 filing fee, a $78 administrative fee (fee schedule) and a $15 trustee surcharge. With the court’s permission you can pay in installments (U.S. Courts), and the fee can be waived if your income is below 150% of the poverty line (28 U.S.C. 1930(f)) |
When a payday lender may object
The Bankruptcy Code lets a creditor ask the court not to discharge a debt obtained by false pretenses, a false representation or actual fraud (11 U.S.C. 523(a)(2)(A)). A lender might raise this, for example, when a loan was taken out shortly before filing, arguing the borrower never meant to repay. The lender has to bring the objection and prove it; it is not automatic. Section 523 also presumes that certain open-end credit cash advances taken shortly before filing are not dischargeable (11 U.S.C. 523(a)(2)(C)). Most payday loans are single-payment loans rather than open-end credit lines, but a bankruptcy attorney can tell you how your loan fits.
Post-dated checks and automatic debits
The automatic stay stops most collection, but it lists the presentment of a negotiable instrument as an exception (11 U.S.C. 362(b)(11)). In practice, a lender holding your post-dated check may still deposit it. If you plan to file, ask your bank about a stop payment order and revoke any debit authorization with the lender and the bank in writing (CFPB). Tell your attorney about every payday lender so each one gets notice of the case.
Steps before you file
- Take the required credit counseling briefing from an approved agency (U.S. Trustee Program).
- List every payday loan: lender name, address, amount, date and any check or debit authorization you gave.
- Avoid taking new payday loans before filing; a recent loan is the one most likely to draw an objection.
- Check whether your income is above your state median; if it is, a means test applies (U.S. Courts).
- Talk to a bankruptcy attorney or legal aid office about Chapter 7 versus Chapter 13 and which property you can keep.

What a payday loan costs
A typical payday loan charges about $15 per $100 borrowed (CFPB). Representative example: you borrow $300 for 14 days and pay a $45 fee, so you repay $345, an APR of about 391%. Rolling it over four times costs $180 in fees while the $300 is still owed. Run your own numbers in our payday loan cost and APR calculator, and see your state’s rules in payday loan laws by state.
Alternatives to bankruptcy
Some borrowers avoid bankruptcy by replacing payday debt with a lower APR personal loan repaid in installments. If you want to compare offers, you can start from our personal loans page to be connected with independent lenders; the service is not available in Arkansas, Connecticut, Georgia, Illinois, Massachusetts, Minnesota, New Hampshire, New York, North Dakota, Vermont or West Virginia. Rates, fees and terms are set by the lender and depend on your credit and state; only refinance if the new APR and total cost are lower, and do not take new debt you plan to include in a bankruptcy.
Frequently asked questions
Can payday loans be discharged in Chapter 7?
Generally yes. They are unsecured consumer debts. A lender can object for a specific loan only on grounds such as fraud, and it must prove them.
Can a payday lender sue me after I file for bankruptcy?
Not while the automatic stay is in effect, and not for a debt that is discharged.
Can a payday lender cash my check after I file?
It may try. The automatic stay has an exception for presenting a negotiable instrument, so talk to your bank about a stop payment.
Is it fraud to take out a payday loan before bankruptcy?
Not by itself. A lender would have to show you obtained the loan by false pretenses or fraud, such as never intending to repay.
How long does Chapter 7 take?
The discharge is generally issued 60 to 90 days after the date first set for the meeting of creditors.
